An Act to provide for the cancellation of bogus entries
made in the record-of-rights relating to Government
land on the basis of forged documents or
in violation of law

No.PAS/Legis-B-15/2009, dated 10-11-2009.---The cancellation of Bogus Entries (in the record-of-rights) of Government Land Bill, 2009 having been passed by the Provincial Assembly of Sindh on Wednesday, the 21st October, 2009 and assented to by the Governor of Sindh on 3rd November, 2009 is hereby published as an Act of the Legislature of Sindh.
Preamble .---Whereas it is expedient to provide for the cancellation of bogus entries made in the record-of-rights relating to government land on the basis of forged documents or in violation of law and to provide for matters connected therewith or ancillary thereto;
It is hereby enacted as follows:--
- Short title and commencement.--- (i) This Act may be called the Cancellation of Bogus Entries (in the record-of-rights) of Government Land Act, 2009.
(ii) It shall come into force at once and shall be deemed to have taken effect on and from 1st January, 1985.
(iii) It shall extend to the whole of the Province of Sindh .
- Definitions.--- (a) "Act" means the Sindh Land Revenue Act, 1967 (Act No.XVII of 1967);
(b) "Bogus Entry" means an entry made in the record-of-rights on the basis of forged documents.
(c) "Government" means Government of Sindh.
(d) "Record of Rights" means and shall have the meaning as defined in section 39 of the Sindh Land Revenue Act, 1967.
Power to cancel the Bogus Entries. ---Notwithstanding anything contained in any law for the time being in force or any agreement or judgment or order of a Court, but subject to other provisions of this Act, the Secretary to Government of Sindh, Revenue Department specifically authorized by the Chief Minister Sindh in this behalf, if satisfied, that an entry in the record of rights, made on or after 1st January, 1985, is bogus, may without notice, cancel such entry and on such cancellation, the land shall stand reverted to the Government.
Appeal. ---(1) Any person aggrieved by an order passed under section 3, may within fifteen days from the date of such order, prefer an appeal to Government and the order of Government shall be final.
(2) The Government may make Rules for carrying out the purposes of this Act.
Overriding Effect .---The provisions of this Act shall have overriding effect, notwithstanding anything contained in any other law for the time being in force.
Indemnity.--- No suit, prosecution or other legal proceedings shall lie, against any person in respect of anything which is in good faith done or intended to be done under this Act.
