ACT XXI OF 1992

ANTIQUITIES (AMENDMENT) ACT, 1992

An Act further to amend the Antiquities Act, 1975

[Gazette of Pakistan, Extraordinary, Part I, 16th September, 1992]

The following Act of Majlis-e-Shoora (Parliament) received the assent of the President on the 14th September, 1992 and is hereby published for general information:--

Whereas it is expedient further to amend the Antiquities Act, 1975 (VII of 1976) for the purposes hereinafter appearing;

It is hereby enacted as follows:--

1. Short title and commencement.--(1) This Act may be called the Antiquities (Amendment) Act, 1992.

(2) It shall come into force at once.

2. General Amendment of Act VII of 1976:-----In the Antiquities Act, 1975 (VII of 1976), hereinafter referred to as the said Act, for the word "Director", wherever occurring the word "Director-General" shall be substituted.

**3. Amendment of section 2, Act VII of 1976.--**In the said Act, in section 2, for clause (b) the following shall be substituted, namely:--

"(b) `ancient', in relation to an antiquity, means an antiquity which has been in existence for a period of not less than seventy-five years;".

4. Amendment of section 3, Act VII of 1976:---In the said Act, in section 3, for subsection (I), the following shall be substituted, namely:--

"(1) For the purposes of this Act, the Federal Government shall, by notification in the Official Gazette, constitute an Advisory Committee comprising of such members, including one member each from the Senate and the National Assembly, as may be deemed necessary. The Chairman of the Advisory Committee shall be the member of Parliament:".

**5. Amendment of section 5A, Act VII of 1976.--**In the said Act, in section 5A, for subsection (3) the following shall be substituted, namely:--

"(3) Where the Director-General decides to take over an antiquity he may pay to the person by whom it is handed over to him such cash reward as the Advisory Committee may deem fit.".

**6. Insertion of new section 13A, Act VII of 1976:-----**In this Act, after section 13, the following new section shall be inserted, namely:--

**"13A. Ownership of buried antiquities.--**Notwithstanding anything contained in any other law for the time being in force, the ownership of all buried antiquities shall vest in the Federal Government.".

**7. Substitution of section 33, Act VII of 1976.--**In the said Act, for section 33, the following shall be substituted, namely:--

"33. Jurisdiction to try offences.---No Court inferior to that of Magistrate of the first class shall take cognizance of or try an offence punishable under this Act."

**8. Amendment of section 37, Act VII of 1976:----**In the said Act, in section 37, in subsection (3), for the words "five hundred" the words "two hundred thousand" shall be substituted.
