CONDUCT OF GENERAL ELECTIONS

(SIXTH AMENDMENT)

ORDER, 2002

CHIEF EXECUTIVE'S ORDER 30 OF 2002

An order further to amend the Conduct of General Elections Order, 2002

F. No.2(4)/2002-Pub. dated 17-10-2002.---The following Order promulgated by the Chief Executive is hereby published for general information:---

Whereas it is expedient further to amend the Conduct of General Elections Order, 2002 (Chief Executive's Order No.7 of 2002), for the purposes hereinafter appearing;

Now, therefore, in pursuance of the Proclamation of Emergency of the Fourteenth day of October, 1999, and the Provisional Constitution Order No. 1 of 1999, and in exercise of all powers enabling him in that behalf, the Chief Executive of the Islamic Republic of Pakistan is pleased to make and promulgate the following Order:--

1. Short title and commencement.---(1) This Order may be called the Conduct of General Elections (Sixth Amendment) Order, 2002.

(2) It shall come into force at once and shall be deemed to have taken effect on and from the 9th October, 2002.

2. Amendment of Article 5, Chief Executive's Order No.7 of 2002.---In the Conduct of General Elections Order, 2002 (Chief Executive's Order No.7 of 2002), hereinafter referred to as the said Order, in Article 5, in clause (4),---

(i) in sub-clause (e), for the semi-colon at the end, a colon shall be substituted and thereafter the following proviso shall be inserted, namely:-

"Provided that for the purpose of this sub-clause, the total number of general seats won by a political party shall include the independent returned candidate or candidates who may duly join such political party within three days of the publication in the official Gazette of the names of the returned candidates;"

(ii) in sub-clause (f), for the semi-colon and word "and" a colon shall be substituted and thereafter the following proviso shall be inserted, namely:-

"Provided that for the purpose of this sub-clause, the total number of general seats won by a political party shall include the independent returned candidate or candidates who may duly join such political party within three days of the publication in the official Gazette of the names of the returned candidates;" and

(iii) sub-clause (g) shall be omitted.

3. Amendment of Article 6, Chief Executive's Order No.7 of 2002.---In the aforesaid Order, in Article 6, in clause (2),---

(i) in sub-clause (d), for the semi-colon and the word "and" a colon shall be substituted and thereafter the following proviso shall be inserted, namely:---

"Provided that for the purpose of this sub-clause, the total number of general seats won by a political party shall include the independent returned candidate or candidates who may duly join such political party within three days of the publication in the official Gazette of the navies of the returned candidates;" and

(ii) sub-clause (e) shall be omitted.
