MARTIAL LAW REGULATIONS

  1. This Regulation shall come into force on the 16th day of October, 1979 and its provisions shall apply to all citizens of Pakistan in any place within and beyond Pakistan.

  2. In this Regulation unless there is anything repugnant in the subject or context, the expression "Political Party" includes a group or combination of persons, organizations, associations or unions who are operating for the purpose of propagating any political opinion or indulging in any other political activity.

  3. (1) Notwithstanding anything contained in the Laws (Continuance in Force) Order, 1977 (CMLA's Order No. 1 of 1977), or in any other law or legal instrument for the time being in force including Martial Law Regulations or Orders, all political parties in Pakistan with all their groups, branches and factions, hereinafter referred to as the parties, shall cease to exist and no person shall henceforth‑

(a) be a member or call himself a member of any of the parties or be an office‑bearer thereof ;

(b) by words either spoken or written or by signs or visible representa tion, propagate the manifesto of or any matter in support of any of the parties ;

(c) operate the accounts of any of the parties in his own name or in any bank, or spend or transfer any amount therefrom.

(2) Any person holding in cash or in his own account or in the account of any of the parties, the funds of any of the parties, shall within 30 days of the coming into force of this Regulation submit to the Chief Martial Law Administrator's Secretariat, the details of receipts, deposits, withdrawals, transfers and expenditure made in respect of the funds since 5th July 1977.

(3) No bank holding the funds of any of the parties shall make any transaction in respect of those funds which now stand frozen.

(4) All banks, holding the accounts of the funds of any of the parties, shall within 30 days of the coming into force of this Regulation submit to the Chief Martial Law Administrator's Secretariat the accounts of such funds, setting out the details of the deposits and withdrawals made from such funds since 5th July, 1977.

(5) Official offices of all the political parties, including places not declared as official offices but used for the purpose of political parties, shall be sealed forthwith alongwith all documents and articles kept therein by the Martial Law authority within whose jurisdiction such an office or place is situate.

  1. No person shall henceforth, directly or indirectly organise or cause to organise or assist or associate in organizing any political party, or indulge in any manner in canvasing or campaigning in public or private in respect thereof.

  2. No person shall henceforth provide financial or other assistance to any of the parties or propagate the cause of any of the parties or any politician by words either spoken or written, or by sign or be visible representation or in any other manner whatsoever:

Provided that the provisions of this Regulation shall not apply to bona fide activity connected exclusively with Trade Unions, Labour Unions, or any other body of similar nature within the limits prescribed by Martial Law Regulation No. 23.

  1. No person shall make any adverse comment by words either spoken or written or by sign or by visible representation or in any other manner what soever censuring any provision of this Regulation or hold a press conference or give a press interview or make a press statement with that object or publish or reproduce such comments or statement of any foreign journalist, leader, press, broadcast or telecast or shall use any provision of this Regulation to excite or attempt to excite disaffection towards the Government in any manner whatsoever.

  2. Whoever contravenes any of the provisions of this Regulation shall be punished with regorous imprisonment for a term which may extend to 14 years and shall also be liable to fine, forfeiture of property and stripes not exceeding twenty five.
