ACT IV OF 1990

CODE OF CIVIL PROCEDURE (AMENDMENT) ACT, 1989

An Act further to amend the Code of Civil Procedure, 1908

[Gazette of Pakistan, Extraordinary, Part I, 8th January, 1990]

Whereas it is expedient further to amend the Code of Civil Procedure, 1908 (Act V of 1908), for the purpose hereinafter appearing;

It is hereby enacted as follows:--

1. Short title and commencement.--(1) This Act may be called the Code of Civil Procedure (Amendment) Act, 1989.

(2) It shall come into force at once.

2. Amendment of First Schedule, Act V of 1908:-In the Code of Civil Procedure, 1908 (Act V of 1908), in the First Schedule,--

(a) in Order XXII, in rule 9, after sub-rule (2), the following new sub- rule shall be added, namely:--

"(3). The provisions of section 5 of the Limitation Act, 1908 (IX of 1908), shall apply to applications under sub-rule (2).";

(b) in Order XLI,--

(i) rule 19 shall be re-numbered as sub-rule (1) of that rule and, after sub-rule (1) re-numbered as aforesaid, the following new sub-rule shall be added, namely:--

"(2). The provisions of section 5 of the Limitation Act, 1908 (IX of 1908), shall apply to an application for re-admission of an appeal dismissed under sub -rule (2) of rule 11 or sub-rule (1) of rule 17."; and

(ii) rule 21 shall be re-numbered as sub-rule (1) of that rule and, after sub-rule (1) re-numbered as aforesaid, the following new sub-rule shall be added, namely:--

"(2) The provisions of section 5 of the Limitation Act, 1908 (IX of 1908), shall apply to applications under sub-rule (1)."
