CODE OF CRIMINAL PROCEDURE (SINDH AMENDMENT) ACT, 2017

An Act to amend the Code of Criminal Procedure, 1898 in its application to the Province of Sindh

No.PAS/LEGIS-B-33/2017, dated 26.2.2018. ---The Code of Criminal Procedure (Sindh Amendment) Bill, 2017 having been passed by the Provincial Assembly of Sindh on 15th January, 2018 and assented to by the Governor of Sindh on 20th February, 2018 is hereby published as an Act of the Legislature of Sindh.

Preamble. ---WHEREAS it is expedient to amend the Code of Criminal Procedure, 1898, in its application to the Province of Sindh, in the manner hereinafter appearing;

It Is hereby enacted as follows:-

1. Short title and commencement. ---(1) This Act may be called the Code of Criminal Procedure (Sindh Amendment) Act, 2017.

(2) It shall come into force at once.

2. Amendment of section 144 of Act No. V of 1898. ---In the Code of Criminal Procedure, 1898, in its application to the Province of Sindh, in section 144 -

(a) in subsection (1), for the words "Zila Nazim", the words "Provincial Government or its authorized officer" and for the words "District Superintendent of Police or Executive District Officer, the words "Deputy Commissioner or District Superintendent of Police" shall respectively be substituted;

(b) in subsection (4), for the words "Zila Nazim" may, either on his own motion", the words "Provincial Government or its authorized officer may, on its or his own motion" shall be substituted;

(c) in subsection (5), for the words "Zila Nazim", the words "Provincial Government or its authorized officer and for the word 'he shall record in writing his reasons", the words "it or he shall record in writing the reasons" shall respectively be substituted;

(d) in subsection (6), for the words "the Provincial Government", the words "the Provincial Government or its authorized officer" shall be substituted: and

(e) subsection (7) shall be omitted.
