JUDGES (LEAVE, PENSION AND PRIVILEGES)

(AMENDMENT) ORDER, 1988

PRESIDENT'S ORDER 5 OF 1988

**No.F.17(1)/88-Pub., dated 29-5-1988.-----**The following Order made by the President is hereby published for general information:--

Whereas it is expedient further to amend the Supreme Court Judges (Leave, Pension and Privileges) Order, 1968 (P.O. No.1 of 19688), and the High Court Judges (Leave, Pension and Privileges) Order, 1970 (P.O.No.9 of 1970), for the purposes hereinafter appearing;

Now, therefore, in exercise of the powers conferred by the Fifth Schedule to the Constitution of the Islamic Republic of Pakistan, the President is pleased to make the following Order:--

1. Short title and commencement.-----(1) This Order may be called the Judges (Leave, Pension and Privileges) (Amendment) Order, 1988.

(2) It shall core into force at once and shall be deemed to have taken effect, on the first day of July, 1987.

**2. Amendment of P.O.No.1 of 1968.--**In the Supreme Court Judges, (Leave, Pension and Privileges) Order, 1968 (P.O. No.1 of 1968), after paragraph 16-A, the following new paragraph shall be inserted, namely:--

"16-B. ++Cost of living allowance in addition to pension.++--A cost of living allowance at the monthly rate specified below shall be paid to a Judge who retires on or after the first day of July, 1987, and is entitled to a pension under this Order so, however, that the aggregate amount of such allowance and such pension does not exceed the maximum amount so specified:--

**3. Amendment of. P.O. No. 9 of 1970.--**In the High Court Judges (Leave, Pension and Privileges) Order, 1970 (P.O. No.9 of 1970), after paragraph 16-A, the following new paragraph shall be inserted, namely:--

"16-8. ++Cost of living allowance in addition to pension++.----A cost of living allowance at the monthly rate specified below shall be paid to a Judge. who retires on or after. the first day of July, 1987, and is entitled to a pension under this Order so, however, that the aggregate amount of such allowance and such pension does not exceed the maximum amount so specified:--

Chief Justice Rs.3,340.00 Rs.7,050.00

Other Judge Rs 2,640.00 Rs.6,300.00"

**4. Cost of living allowance to cease to be admissible on revision of pension of Judges.--**The cost of living allowance provided for in this Order shall cease to be admissible on the which an amendment of the Fifth Schedule to the Constitution of the Islamic Republic of Pakistan to revise the pensions payable to the Judges of the Supreme Court and the High Courts comes into force.
