MARTIAL LAW ORDERS

No. 104

Whereas it is expedient in the public interest to make recoveries of certain Government dues outstanding against defaulters ;

Therefore, I, Lieut.-General Bakhtiar Rana, SQA, PAC, Martial Law Administrator, Zone `B' hereby order

1, (a) Whoever fails to pay Government dues outstanding against him on account of leases of land and contracts of Forest produce obtained from Forests Department, purchase of seed, implements and fertilizers from the Agriculture Department or hire charges of agricultural machinery hired from the Agriculture Department, within one month of the issue of a Notice of demand by a Divisional Forest Officer/Deputy Director of Agriculture/ Superintending Engineer, Agriculture, shall be liable to punishment under CMLA Reg. No. 16

The service of Notice shall be deemed to have been adequately made if a copy of the Notice is sent by registered post acknowledgment due at the last known address of the defaulter and is pasted at the door of the house of the defaulter and is published in a daily paper having circulation in area where the Defaulter r--sides.

The arrears outstanding against such person shall be recovered as if they were arrears of land revenue, notwithstanding the fact that the defaulter has been punished under CMLA Reg. No 16.

2 No provision of this order shall be called in question in any Court including the High Court and Supreme Court or before any authority. No suit or legal proceedings shall lie against Government or any person in respect of anything done in good faith intended or purported to have been done in relation to any proceedings under this order.

  1. Notwithstanding anything to the contrary contained in any law, order of decree of any Court or the authority or any contract deed or other documents the provision of this order will have immediate effect.
