MARTIAL LAW ORDERS

Whereas it is expedient in the public interest to lay-out areas for public Parks and Gardens and also to reconstruct and renovate places of Historical interest, in the City of Lahore ;
And whereas, the Lahore Improvement Trust (hereinafter referred to as the said Trust) notified a scheme under section 36 of Punjab Town Improvement Act. 1922 on 15th April 1955 for the development of the area known as Anguri Bagh opposite to Shalamar Garden ;
And whereas, the same was sanctioned by the Provincial Government,--vide Notification No. S. O. (T)-1-G/58, dated 28th November 1958 ;
Now therefore, I, Lt.-General Bakhtiar Rana, SQA, MC, ADC, Martial Law Administrator, Zone `B' hereby order as under :
That the Commissioner, Lahore Division shall take possession forthwith of such land as is included in the Anguri Bagh Development Scheme referred to above and is bounded on the North by G. T. Road, on the East by Shalamar Escape, on the South by Shalamar Distributary and on the West by Shalamar Link Road, Lahore (hereinafter referred to as the said property), summarily ejecting, if necessary, any person or persons in occupation of any part thereof.
The said property shall be transferred to the said Trust who will be put in possession thereof and the said property shall be deemed to have been duly acquired by the said Trust free from all encumbrances.
The compensation for the land and standing crops, trees or structures on the said property will be assessed by the Land Acquisition Collector, of the said Trust and shall be subject to confirmation by the Commissioner, Lahore Division, Lahore , whose order shall be final.
(4) The compensation so assessed shall be paid by the said Trust before the 30th May 1962 .
(5) Notwithstanding anything contained in the Punjab Town Improve?ment Act, 1922, the Chairman of tae said Trust subject to the over all super-vision of the Commissioner, Lahore Division-
(i) shall forthwith lay-out the area thus acquired as a Public Park and, if necessary, also provide sites for residential purposes and sale thereof to the public ;
(ii) may require the purcha^s^ers of such residential sites to erect such structures within such period as he may determine and shall do all other things necessary for the establishment of the said Public Park in so-called area.
(iii) shall determine the terms and conditions of the payment to the said Trust of the sale price of the sites sold and the method of recovery in case of default.
- No provision of this Order shall be called in question in any Court, including High Court and the Supreme Court. No suit, prosecution or other legal proceedings shall lie against the Government, the said Trust, or any member, Officer or servant of the Government or the said Trust or any person acting under the orders of the Commissioner, Lahore Division or the Chairman of the said Trust in respect of anything done or intended to be done in good faith under this Order.
