THE MERCHANT SHIPPING (NATIONAL COLOURS) ACT, 1949

ACT No. V OF 1950

This Act has been applied to the territory of Gwadur by the West Pakistan Ordinance 36 of 1959 (with effect from the 16th June, 1959).)

An Act to provide for national colours for ships registered in, or owned by persons domiciled in, or bodies corporate established in Pakistan

WHEREAS it is expedient to make provision for national colours to be worn by ships registered in, or owned by persons domiciled in, or bodies corporate established in Pakistan;

1. Short title extent and commencement.-(1) This Act may be called the Merchant Shipping (National Colours) Act, 1949.

(2) It extends to the whole of Pakistan.

(3) It shall come into force on such date**(** The 1st March, 1950, see Gaz. of P., 1950, Pt. I, p. 94.) as the Central Government may, by notification in the official Gazette, appoint in this behalf.

2. Proper national colour for ships registered or owned in Pakistan. -(1) The Central Government may, by notification in the official Gazette, declare**(** For such declaration, see Gaz. of P., 1958, Pt. I, pp. 442-443.) the proper national colours for all ships registered in Pakistan, and for all vessels which are not registered in any British possession but are owned exclusively by persons domiciled in Pakistan or by bodies corporate established in Pakistan, and thereupon the colours so declared shall, in relation to all such ships and vessels, be the proper national colours for the purposes of sections 73 and 74 of the Merchant Shipping Act, 1894, 57 & 58 Vict., c. 60.

(2) Any person hoisting on board any such ship or vessel any colours other than the colours so declared shall be punish able with the penalty prescribed in sub-section (2) of section 73 of the Merchant Shipping Act, 1894.

(3) The Central Government may, by notification in the official Gazette, exempt any ship or vessel or any class of ships or vessels from the operation of this section.
