NORTH-WEST FRONTIER PROVINCE CIVIL SERVANTS (AMENDMENT) ORDINANCE, 2000

ORDINANCE VIII OF 2000

An Ordinance further to amend the North-West Frontier Province Civil Servants Act, 1973

No. Legis.-1(21)/73-II, dated 20-11-2000.---The following Ordinance by the Governor of the North-West Frontier Province is hereby published for general information:--

Whereas it is expedient further to amend the North-West Frontier Province Civil Servants Act, 1973 (N.-W.F.P. Act No. XVIII of 1973), for the purpose hereinafter appearing;

And whereas the Provincial Assembly stands suspended in pursuance of the Procl4mation of Emergency of the fourteenth day of October, 1099, and the Provisional Constitution Order No. 1 of 1999;

And whereas the Governor of the North-West Frontier Province is satisfied that circumstances exist which render it necessary to take immediate action;

Now, therefore, in pursuance of the Proclamation of Emergency of the fourteenth day of October, 1999, and the Provisional Constitution Order No. 1 of 1999, read with Article 4 of the Provisional Constitution (Amendment) Order No.9 of 1999, and in exercise of all powers enabling him in that behalf, the Governor of the North-West Frontier Province, on the instructions of the Chief Executive of Pakistan, is pleased to make and promulgate the following Ordinance:

1. Short title, extent and commencement.---(1) This Ordinance may be called the North-West Frontier Province Civil Servants (Amendment) Ordinance, 2000.

(3) It shall come into force at once.

2. Substitution of section 13 of N.-W.F.P. Act No. XVIII of 1973.- In the North-West Frontier Province Civil Servants Act, 1973 (N.-W.F.P. Act No. XVIII of 1973), for section 13 the following shall be substituted, namely:--

"13. ++Retirement from service++.--(1) A civil servant shall retire from service--

(a) on such date after he has completed twenty-five years of service qualifying for pension or other retirement benefits as the competent authority may, in public interest, direct; or

(b) where no direction is given under clause (a), on the completion of sixtieth year of his age.

(2) No direction under clause (a) of subsection (1) shall be made until the civil servant has been informed in writing of the grounds on which it is proposed to make the direction, and has been given a reasonable opportunity of showing cause against the said direction.

Explanation.--In this section, the expression "competent authority" means the appointing authority prescribed in rule 4 of the North-West Frontier Province Civil Servants (Appointment, Promotion and Transfer) Rules, 1989."
