NORTH‑WEST FRONTIER PROVINCE FOODSTUFFS (DISPOSAL AND REWARD) RULES, 1972

No. 8751/G‑368.‑In pursuance of the provisions contained fn section 6‑A of the West Pakistan Foodstuffs (Control) Act, 1958 (W. P. Act No. XX of 1958), the Governor of the North‑West Frontier Province, is pleased to make the following rules, namely :‑

*1. Short title, extent and commencement.‑(1)*These rules may be called the North‑West Frontier Province Foodstuffs (Disposal and Reward) Rules, 1972.

(2) They shall extend to the whole of the North‑West Frontier Province, except the Tribal Areas.

(3) They shall come Into force at once.

  1. Definitions.‑In these rules, unless the context otherwise requires, the following expressions shall have the meanings hereby respectively

assigned to them, that is to say‑

(a)"Act" means the West Pakistan Foodstuffs (Control) Act, 1958;

(b) "District Food Controller" or "Rationing Controller" means the District Food Controller or the Rationing Controller of the Food Department;

(c) "Government" means the Government of the North‑West Frontier Province; and

(d)"notified order" means an order notified under section 3 of the Act.

*3. Disposal of forfeited foodstuff:‑(1)*Any foodstuff forfeited to Government under the provisions of the Act or notified order shall be handed over for disposal to the District Food Controller or the Rationing Controller of the District concerned.

(2) District Food Controller or the Rationing Controller to whom the foodstuff is handed over under sub‑rule (1) shall dispose it of‑

(i) if the forfeited commodity is of standard quality and is not in deteriorated condition through the authorised dealer or a rationing depot holder in such manner and at such rate as may, from time to time, be prescribed by the competent authority;

(ii) if the forfeited commodity is not of a standard quality or is in a deteriorated condition, by auction after first obtaining permission from the competent authority.

(3) The proceeds of sale or auction, as the case may be, of the forfeited commodity shall be credited into Government Treasury under the Head "XLVI‑Miscellaneous, etc. Provincial".

4, Reward to informer.‑‑(1) Ina case, whether ending in conviction or not, in which the food‑stuff has been forfeited to Government, the Court trying the offence may order payment of a reward not exceeding one‑fourth in value of the quantity confiscated to the person or persons responsible for the detection of the case.

(2) The District Food Controller or the Rationing Controller shall pay reward to such person or persons, in accordance with the order made by the trying Court under sub‑rule (1).
