ACT I OF 1992

NORTH-WEST FRONTIER PROVINCE LOCAL GOVERNMENT (AMENDMENT) ACT, 1992

An Act further to amend the North-West Frontier Province Local Government Ordinance, 1979

No. PA/NWFP/Legis/92/1397, dated 26-1-1992.--The North-West Frontier Province Local Government (Amendment) Bill, 1992, having been passed by the Provincial Assembly of the North-West Frontier Province on the 12th January, 1992 and assented to by the Governor of the North-West Frontier Province on the 20th January, 1992, is hereby published as an Act of the Provincial Legislature of North-West Frontier Province.

**Preamble.--**Whereas it is expedient further to amend the North-West Frontier Province Local Government Ordinance, 1979 (N.-W.F.P. Ordinance IV of 1979), for the purpose hereinafter appearing;

It is hereby enacted as follows:--

1. Short title and commencement.--(1) This Act may be called the North-West Frontier Province Local Government (Amendment) Act, 1992.

(2) It. shall come into force at once.

**2. Amendment of section 28 of N.W.F.P. Ordinance IV of 1979: -**In the North-West Frontier Province Local Government Ordinance, 1979 (N.-W.F.P. Ordinance IV of 1979), hereinafter referred to as the said Ordinance, in section 28, after clause (e), the following new clause (ee) shall be inserted, and the explanation appearing at the end shall be omitted.

"(ee) if he is, or has been a Chairman of the Zakat and Ushr Committee within two years of the filing of nomination papers for election to the Local Councils."

**3. Addition of new section 28-B in the N.W.F.P. Ordinance IV of 1979: -**In the said Ordinance, after section 28-A, the following new section 28-B shall be added, namely:--

"28-B. ++Bar against double membership.++-(i) No member shall at the same time be a member of a Local Council and the Provincial Assembly or the Parliament;

(ii) if a person is elected to a seat in a Local Council and a seat in the House of Parliament or in the Provincial Assembly, he shall within a period of 15 days from the date of election resign one of his seats, if he does not so resign, the seat in the Local Council shall become vacant on the expiration of the said period."
