NORTH‑WEST FRONTIER PROVINCE MUQARRARIDARS (CONFERMENT OF PROPRIETARY RIGHTS) ORDINANCE, 1995

An Ordinance to provide for conferment of proprietary rights on Muqarmridars in the North‑West Frontier Province

No. Legis/1(11)/71, dated 26‑2‑1995.‑‑The following Ordinance by the Governor of the North‑West Frontier Province is hereby published for general information:‑‑

Preamble.‑‑Whereas it is expedient to provide for conferment of proprietary rights on Muqarraridars in the North‑West Frontier Province.

And whereas the Provincial Assembly is not in session and the Governor of the North‑West Frontier Province is satisfied that circumstances exist which render it necessary to take immediate action.

Now, therefore, in exercise of the powers conferred by clause (1) of Article 128 of the Constitution of the Islamic Republic of Pakistan, the Governor of the North‑West Frontier Province is pleased to make and promulgate the following Ordinance.

  1. Short title, extent‑ and commencement.‑‑(1) This Ordinance may be called the North‑West Frontier Province Muqarraridars (Conferment of Proprietary Rights) Ordinance, 1995. '

(2) It shall extend to the whole of the North‑West Frontier Province.

(3) It shall come into force at once.

  1. Definitions: ‑(1) In this Ordinance, unless there is anything repugnant in the subject or context,‑‑

(i) "Government" means the Government of the North‑West Frontier.

(ii) "Muqarraridar" means any person who holds land owned or administered by Government and has been entered as Muqarraridar in the Revenue Records before the commencement of the North‑West Frontier Province Tenancy Act, 1950 (Act XXV of 1950), and includes his successors‑in -interest;

(iii) "prescribed" means prescribed by rules made under this Ordinance. .

(2) Words and expressions not specifically defined here shall have the same meanings as are assigned to them in the West Pakistan Land Revenue Act, 1967 (W.P. Act XVII of 1967).

  1. Conferment of proprietary rights on **Muqarraridars.‑**Notwithstanding anything to the contrary contained in any law for the time being in force, any person entered as Muqarraridar in relation to land owned or administered by Government shall become full owner thereof on payment of compensation to Government at such rate, within such period and on such terms and conditions as may be prescribed.

  2. Power to make rules.‑‑Government may make rules to carry out the purposes of this Ordinance.
