NATIONAL ELECTRIC POWER REGULATORY

AUTHORITY (NEPRA) SERVICE REGULATIONS, 2003

(Amendments)

S.R.O.1378(I)/2012, dated 19-11-2012.---In exercise of the powers conferred of section 10(1) and section 47(2) of the Regulation of Generation, Transmission and Distribution of Electric Power Act (XL of 1997), the National Electric Power Regulatory Authority (NEPRA) is pleased to approve the following amendments in the National Electric Power Regulatory Authority (NEPRA) Service Regulations, 2003 (earlier notified vide S.R.O.544(I)/2003, dated 12-6-2003 and S.R.O. 203(I)/2012, dated 28-2-2012), namely:--

In the aforesaid Regulations:--

  1. Amendment of regulation 3. -(1) In regulation 3, in sub-regulation (1), the words "designation wise" shall be omitted.

(2) In sub-regulation (1)(a), after the words "Regulatory matters" a full stop shall be inserted and thereafter the remaining sentence shall be substituted with the following:

"The detail of sub-cadres which fall in this group shall be:

(3) In sub-regulation (I)(b), in the second sentence, the word "designations" appearing after the words "The details of shall be substituted by the words "sub-cadres", and the word "are" appearing after the words "this group" shall be substituted by the words "shall be the same as".

  1. Amendment of regulation 7 .- In regulation 7, the sub-regulation (4) shall be omitted.

  2. Amendment of regulation 11. - Regulation 11 shall be substituted with the following:

"Appointments to various posts shall be made on an all Pakistan basis in accordance with the merit and provincial / regional quotas prescribed by the Federal Government for civil posts from time to time. The posts in each grade shall be considered separately for the purposes of allocation of prescribed merit and provincial/regional quotas. The unfilled vacancies reserved for merit and provincial/regional quotas for which qualified candidates are not available shall be carried forward except for the posts in NSG-1 grade, which may otherwise be filled on local basis."

  1. Amendment of regulation 31. -In regulation 31, in sub-regulation (4) "comma" appearing after the word "suspension" shall be substituted with "full stop" and remaining sentence to be deleted.

  2. Amendment of regulation 32. -In regulation 32, in sub-regulation (4), the second sentence starting from "If, however," shall be substituted with the following:

"In cases where an employee is called for duty on a closed holiday, he/she should be allowed off-day in lieu thereof, in the same calendar year. In case the compensatory leave is not allowed, the employee will be entitled for compensatory allowance as prescribed by the Authority from time to time."

  1. Amendment of regulation 34. -(1) In regulation 34, in sub-regulation (2) (i), the figure "60" shall be substituted by "90".

(2) The sub-regulation (4) shall be substituted with the following:--

"The Employee will have the option to encash his/her un availed earned leave at his/her credit at the end of a calendar year or at the time of his/her retirement."

  1. Amendment of regulation 35. - In regulation 35, at the end of sub-regulation (3), the following sentence shall be added:

"However, the maximum number of leaves to be encashed on retirement shall not be more than 18 months i.e. 540 days."

  1. Insertion of new regulation 37(A). -After regulation 37, the following new regulation shall be inserted, namely,-

"37(A) EX-PAKISTAN LEAVE"

"An employee may be granted ex-Pakistan leave subject to the same limits as prescribed in the case of earned and extraordinary leaves."

  1. Amendment of regulation 38. - (1) In regulation 38, in sub-regulation (2)(ii) the words "medical attendant" shall be substituted with the words "medical board".

(2) In sub-regulation (2) (iii) the word "attendant" at the end of the sentence shall be substituted with the word "board".

(3) In sub-regulation (3), the words "hospital/doctor" shall be substituted with "of experts/board"

  1. Amendment of regulation 41. -In regulation 41, the figure "180" shall be substituted with "120".

  2. Amendment of regulation 43. -In regulation 43, in sub-regulation (2), the words "after availing of such" shall be substituted with the words "from medical"; and the words "produce a" shall be substituted with the word "provide"; and the words "authorized medical attendant" shall be substituted with "a medical officer on NEPRA's panel".

  3. Amendment of regulation 73.--- Regulation 73 shall be substituted as under:

(1) Employees shall be allowed an interest free advance by way of loan, equivalent to fifteen basic monthly salaries of the employee, which shall be payable by the employee in sixty equal installments through monthly deduction from salary. The employees whose superannuation is due in next five years, the number of installments will be reduced accordingly to ensure settlement of loan before retirement.

(2) The vehicle for which an interest free loan is granted to an employee, shall be mortgaged in the name of NEPRA and shall remain as such till the entire loan amount is repaid by the employee.

(3) Employees requesting for an interest free loan under this arrangement shall have to provide

(i) A surety bond equivalent to the amount of loan and guarantee of two responsible persons (acceptable to the Authority) to ensure the repayment of the loan within the specified time.

(ii) An affidavit that the employee will serve NEPRA for at least 5 years after receipt of the loan, failing which the employee will have to deposit the remaining amount of the loan along with the interest at the rate of eight per cent on the amount of loan for the period, the loan amount was utilized by the employee.

(iii) Proof of purchase and registration in the name of the employee shall have to be provided within six months of the receipt of the loan provided that extension in such period may be allowed by the Authority where a new car has been booked by the employee and is not available within the six mouths of the receipt of the loan from NEPRA.

(iv) A copy of valid driving license issued by the traffic police.

(4) Loans shall be allowed to employees according to the budget/finance availability as per pay-scale wise quota decided by the Authority from time to time.

(5) Those employees who already own a vehicle in their name and have exercised the option for vehicle maintenance and usage shall be allowed the VMUA, however the loan facility shall be allowed only to the extent of the replacement price of the existing vehicle with the new one subject to a limit of 12 basic monthly salaries of the employee.

  1. Amendment of regulation 94. -(1) In regulation 94, in sub-regulation (1) shall be substituted as:-

"Outdoor Treatment For Minor Ailments - This will cover ailments of minor nature when the patient does not require stay in hospital and requires only consultation with a physician/general practitioner to obtain prescription and purchase of related medicines at facilities or hospitals designated by the Authority or from the open market. 80% payment for such treatment shall be paid by NEPRA and 20% shall be charged to the employee. This facility shall be available to all the employees and their families".

(2) In regulation 94, in sub-regulation (2), in the second line of clause (a) after the word "declares" the words and commas ", in writing," shall be omitted. In the same clause, in the same line, the words "would be" shall be substituted with the word "as".

  1. Amendment of regulation 97. -(1) In regulation 97, in sub-regulation (4), the types of accommodation shall be substituted with the following:

"NSG 1 to 6 General wards

NPG 1 to 3 Semi-private rooms

NPG 4 and above Private rooms"

  1. Amendment of regulation 105. - (1) In regulation 105, after sub-regulation (2)(b) a new clause (c) shall be inserted as per following:

"(c) Removal from service; and"

(2) In sub-regulation (2)(c), the word "and" appearing after semi-colon shall be omitted and semicolon shall be substituted with comma.

(3) In sub-regulation (2) the existing clause (c) shall be renumbered as (d).

(4) The following note at the end of regulation 105 shall be inserted:

"[Removal from service does not, but dismissal from service does, disqualify for future employment.]"

  1. Substitution of Appendix-2. - The Appendix-2 shall be substitu ted with the following Appendix--2:

  2. Substitution of Appendix-5.- The Appendix -5 shall be substituted with the following Appendix-5:--
